Terms Of Service / Acceptable Usage Policy
All customers/subscribers to Revolution Hosting web hosting services are required to abide by this TOS/AUP.
Failure to do so can result in account suspension and/or termination.
TERMS OF SERVICE
Payments
|
All payments to Revolution Hosting are non-refundable, unless otherwise stated.
All payments are stated on this website and are to be paid in US currency.
Revolution Hosting reserves the right to assess additional fees, including those for add-ons, and excessive resource usage, such as bandwidth overage fees.
Should any payments not be made in full, Revolution Hosting reserves the right to withhold domain and website information until any applicable balance has been cleared.
If any charge is in dispute, the client agrees to contact Revolution Hosting and allow a period of no less than 72 hours for administrators to review the request and respond appropriately.
Should a payment ever be disputed with a bank or other third-party without notifying or attempting to resolve the issue with Revolution Hosting beforehand, an "Administrative Fee" of no less than $25.00 and no more than $100.00 will be assessed on the customer's account, regardless of the outcome or reason.

Cancellation
|
Accounts paid on a month-to-month basis can be cancelled at any time by the confirmed account holder via e-mail or telephone for no extra charge.
No refunds will be made on month-to-month account cancellations, unless otherwise stated.
For accounts purchased on a yearly or semi-yearly basis, the client is required to pay 50% of the remaining service fees if he/she decides to cancel their account before the contract period is up.
If the account is paid in full in advance, Revolution Hosting agrees to refund 50% of the remaining fees, not including setup or domain registration fees.
This cancellation policy applies to used *and* un-used accounts, since as long as you have access to use your account (and have not notified us of your intention to cancel it), it is your *choice* to not utilize it.

Free Domains
|
This section only applies to any applicable FREE domain registration promotions - not to customers who pay for domain registrations through us.
We are not a low-cost domain registrar, and as such, when we offer free domains with our hosting packages, we hope that you will use our hosting as well.
To ensure there is no abuse of our free domain promotions, we require that every customer receiving a free domain that also wishes to transfer the domain at a later time must host with us for at least 2 months.
Alternatively, a customer can choose to not host with us for that amount of time, and simply pay our regular domain registration fee listed on our website to be able to transfer. We do not prefer to hold domains, and fully support your free choice of other web hosting services.

SLA (Service Level Agreement)
|
Revolution Hosting agrees to provide service guaranteed to be accessible by the majority of internet users 99% of the time (for shared hosting - dedicated server SLAs separate), each month.
This agreement excludes scheduled maintenance, which will be announced through our support forums no less than 6 hours in advance, acts of God (fire, rain, earthquake), DoS (Denial of Service) attacks, issues with user ISP's and hardware failures.
Should this SLA be breached, Revolution Hosting will credit your account 25% of the monthly fee for 98% to 99% uptime, 50% of the monthly fee for 95% to 98% uptime, or 100% of the fee for lower than 95% uptime, as requested (and proven) by the customer, no later than 30 days following the downtime.

Privacy Policy
|
Revolution Hosting agrees to respect the client's privacy at all times.
No personal or contact information will be shared to any third-party for any marketing purposes except when client is duly informed beforehand and agrees to the release.
All transactions related to financial or personal details are conducted either through own secure servers or third-party payment processors over a 128-bit (or if applicable, 256-bit) SSL connections for maximum security.
Additionally, only required financial details are permanently stored on our servers, and they are RSA encrypted with access limited on a "need-to-know" basis.
No client account or website information will be publicly released on the Revolution Hosting website *without prior permission from the client*, and Revolution Hosting agrees to inform any affected clients if there is a possible breach of server security that may have compromised their personal and/or account/website information.

Indemnification
|
Revolution Hosting wishes to emphasize that in agreeing to the Revolution Hosting's Acceptable Use Policy (AUP) and Terms of Service (ToS),
the customer indemnifies Revolution Hosting for any violation of the Acceptable Use Policy (AUP) and Terms of Service (ToS) that results in loss to us
or the bringing of any claim against us by any third-party.
This means that if Revolution Hosting is sued because of the actions of a customer or a customer of a customer (in the case of a reseller account),
the customer will pay any damages awarded against Revolution Hosting, plus all costs and attorney's fees.

Refusal of Service
|
Revolution Hosting reserves the right to refuse service to any customer or user of our services at any time for any reason, and at our sole discretion.
|
Modification of this Agreement
|
Revolution Hosting reserves the right to modify this agreement at any time, without prior notification.
|
ACCEPTABLE USAGE
Illegal Material
|
Only legal files (as determined by the government of the United States, and the State of Texas) can be stored on our servers.
Revolution Hosting reserves the right to search your webspace, without warning, should we reasonably suspect that your files contain illegal content.
|
Spam Policy
|
Revolution Hosting has an extremely strict policy on SPAM (unsolicated mass e-mails).
Should any site be seen sending large numbers of e-mails, we have the right to disable the account, without warning, and view the contents of the e-mail messages.
We recommend that if you are running a mailing list service, or decide to e-mail many of your *registered and opt-in* site users, you should contact us first, to prevent your account from being disabled.

Adult Material
|
Due to the questionable practices of many adult/pornographic websites, as well as the unique server and network resources they require, we do not host any 'adult-only' content websites.
Should your site have adult-oriented humor or other non-pornographic information, please contact us to determine if it is allowed.
|
Server/Network Security
|
Any client who attempts to breach any security measures of Revolution Hosting's server or network will be subject to immediate account termination and possible legal action.
Should any user utilize Revolution Hosting resources to perform an illegal act, attempt to breach security on another server/network or in any way compromise the security of any system or service will also be subject to immediate account termination and legal action.

Dynamic Server-Side Scripts (CGI/Perl/PHP) (Shared/Reseller Accounts Only)
|
Dynamic scripting helps to enhance the quality and interactivity of websites greatly.
However, it also puts a heavy strain on server resources.
To ensure that Revolution Hosting can continue to provide these powerful features safely and effectively while ensuring quality of service for all of our customers, we need to put limits on the usage of server resources.
No Perl-based chat room or messaging scripts are allowed.
All scripts should execute within 5 to 10 seconds, or be subject to removal.
No script should excessively access external resources, such as files, databases or other servers during its execution time.
Scripts that are written for the sole purpose of affecting the server or any clients in an adverse manner are completely forbidden.

Background Processes (Shared/Reseller Accounts Only)
|
We do not allow users to run *any* background server processes in any form, shape or fashion.
Process lists will be actively monitored for any such programs, and accounts may be disabled immediately, without prior warning, should any background processes be discovered.
|
Shell/Terminal Access (Shared/Reseller Accounts Only)
|
Revolution Hosting currently offers shell/terminal access to customers on our shared servers on a per-request basis.
Should you require these services, we will be happy to review such requests, although we recommend you look into a dedicated server for increased control over your site files and applications.
